Do You Understand Maryland's New Marijuana Law?

Certain things surrounding marijuana still lead to criminal charges.

Possessing small amounts of marijuana will not be a criminal offense in Maryland after Oct. 1. Offenders caught with less than 10 grams of marijuana will not be arrested, face jail time or receive a criminal record, under legislation approved by the General Assembly and Gov. Martin O’Malley in April.  

Under the new law, possession of paraphernalia remains a criminal offense that can lead to jail time. Someone caught with joint could be arrested and charged criminally not for possessing marijuana, but for the rolling paper surrounding it.

Not by themselves, but I believe if you are caught with pot and papers they are considered paraphernalia. Even though the small amount of pot you have is not criminal, the papers are. Go figure...

Papers are legal you can buy them at almost any gas station or 7-Eleven. I used to work with an old guy who roled his own cigarettes. It's just like the little pipes used for smoking it, you can buy them many place including online, I guess it's how you use it that makes the difference. PVC pipe is legal until you fashion it into a potato gun.

You can buy a pipe anywhere...no problem. But if you get caught with pot and the pipe is nearby, that very legal pipe suddenly becomes paraphernalia and illegal. Of course it's not illegal to buy or have rolling papers, unless there is pot in or around them. Go ahead and test your theory and get back to us.
