According to the Daily Record, The Carroll County Times reported that Daggett testified he had not been called by the police after DeMario’s body was discovered Sept. 14, 2010. The Times reported that it secured phone records that showed Daggett did have a phone conversation with a sargeant at the scene the night of the killing.

In his lawsuit, Daggett said his testimony addressed not whether he spoke to a police investigator but if he had been asked questions by him.

Daggett claims in his lawsuit that he truthfully testified that he did not receive a call from a police officer with questions about the slaying, and he says he has suffered humiliation, depression and financial losses as a result of the news report, according to the Daily Record.

Barnes told Patch in an email he could not comment on the story.
